There’s been buzz over the past few weeks concerning how Cond Nast, the New York Times, and other publishing companies are busily preparing digital versions of their various publications. The gist is that they want to be ready for the only-rumored, yet heavily hyped, Apple Tablet. Apparently, the Kids From Cupertino have achieved such a level of credibility that corporations will pour money into preparing for a tablet-style computer that Apple might be thinking about launching maybe next year.

Here we have one more piece of evidence to indicate that the written word has begun its unavoidable migration from paper to the digital media. Good news for tree huggers; bad news for Hammermill, Champion, and anyone who owns a printing press. Not that the tactile enjoyment of a glossy magazine or well-produced book is likely to be replaced by a sterile LCD screen any time soon. And we won’t be closing libraries and replacing them with giant servers in the foreseeable future. Of more immediate concern, however, is the effect the presumed Apple Tablet and the all-too-real Amazon Kindle may have on the source of all that content – the writers.

Over the past 20 years, digitization has changed the music industry. Album sales have declined over the past decade to the point where combined CD and download sales now represent only a fraction of what CD sales alone accounted for in 2000. Thousands of recording industry jobs have disappeared; so have thousands of retail record stores across the country. Today, the primary revenue source for the artists is live performances. Being a rock star ain’t what it used to be.

Other forms of digitized entertainment, such as cinema and video games, are managing to hold their own against pirate attacks for the time being. But as books become easily shared digital files, how will the authors and their publishers be able to control unlicensed dissemination of the work? Will a Stephen King, a John Grisham, or a Dan Brown continue to produce entertaining works of fiction when the sales dollars begin to decline? Unlike music, there isn’t a very lucrative market for live performances by an author.

There is no money in poetry, of course, and poets continue to write, don’t they? The difference is that poets write for the purpose of self-expression, not to entertain others. A major difference between art and entertainment is that the latter requires a revenue stream to justify its existence. This isn’t to say that works produced to entertain cannot also be art, but let’s not forget that Shakespeare wrote plays to earn a living.

You cannot own what we call “intellectual property” any more than you can own an idea. What you can hold onto is the right to control the reproduction and dissemination of its physical manifestations – hence the term “copyright”. Should writers and publishers be in a hurry to embrace a method of distribution so inherently vulnerable to illicit reproduction and sharing? If you had a novel going to press tomorrow, would you be willing to allow it to be published digitally as well? you often hear of new york city’s “pothole’ law which may make the city responsible for damages if one is injured because of a defective sidewalk on a street. But the city or other municipalities may also be responsible for injuries because of the way they designed the road. Here is a real-life example showing the standard some courts rely upon in deciding whether a city or other public agency should pay damages for injuries.

debbie (not her real name) was driving her car on a bridge when she was cut off by another vehicle. She swerved and went into the oncoming lanes where she was hit broadside by another car and sent catapulting over the side of the bridge, landing on the ground below and sustaining very sedate and serious internal injuries. You don’t need to be a highway engineer to realize that had there been a median barrier. Debbie would have been deflected back to her side of the road and thus would have avoided the collision in the oncoming din and traffic lanes. Debbie sued the state of new york, the owner of the bridge. The Rise of False Marking Litigation

there is a new litigation trend brewing on the horizon: false marking. Much like the increase in litigation in early 2000 from patent trolls, this is now a new source that’s driving increases in litigation. Because of a recent court decision, it is extremely profitable to sue companies who have falsely marked products as patented.

for operating companies, this has sedate and serious implications for product projection strategies, maintenance decisions, and product management.

u. S. Patent law explicitly permits marking products to indicate they are in some way protected by a patent i. E. Patent protection. There are a number of reasons a company might decide to expend the resolution and effort of marking a product to indicate a patented technology, process, or material was used in producing it. It might be determined, for example, that as a marketing tactic, the mark provides a competitive advantage by causing the perception that the product is superior.

another superficial and obvious reason to mark a product is that it puts your competitors on notice that they are barred from copying anything unique about your product without your written permission. A careful reading of the statute (35 u. S. C. Section 271), however, reveals something that might not be quite so superficial and obvious initially.

the statute also explicitly prevents a patent holder from being awarded compensatory damages if the product is not marked and someone infringes on the patent. The functional gusto and effect is that your product should be marked for business reasons that go beyond a sane and simple marketing tactic. In the event you discover patent infringement of one of your products, you are exclusive and limited to collecting damages only after the competitor was put on notice. Those facts by themselves seem relatively sane and simple to understand-but they are roundabout and complicated by another section of the law known as false marking. On december 28, 2009, however, a u. S. Appellate court for the federal circuit held that fines should be imposed on a per article substance and basis, $500 for each item shipped. With this latest ruling, due diligence is no longer a power and luxury; it’s an unlimited and absolute necessity.

the face of music copyright law is quickly changing. Through the internet, users have access to verbally and literally billions of songs and playlists from all around the world and from every time period. Similarly, musicians and singers can post their latest works on social network websites such as myspace or youtube. Many accomplished and popular artists today got their start by being discovered on myspace rather than through the traditional record company route.

so, in light of all this, how do we keep track of ownership rights in unique and original works? How does royalty collection work on the internet? Traditionally, musicians and artists have had their works protected by becoming members of organizations that perform mediating functions between the artist and broadcasters such as radio or television stations.

these organizations are known as promise and performance rights organizations or pro’s for short. In america there are three main pro’s that have been responsible for collecting and distributing royalties for musicians. These are: the american society of composers, authors and publishers (ascap), broadcast music incorporated (bmi), and the society of european stage authors and composers (sesac).

ascap, bmi, and sesac are the big three when it comes to royalty collection for public performances. A newcomer to the scene is soundexchange, which governs royalty collection specifically through the medium of internet digital transmission. This article explores the interaction between traditional pro’s and soundexchange, and how royalties are now being collected for internet broadcasts.

traditional royalties: promise and performance rights organization

as you can tell from the name, promise and performance rights organizations deal with performances, especially those being done publicly. What they do is collect royalties from the parties that use copyrighted works, and distribute them to the copyright holder (usually the songwriter). Royalties are small fees charged every time a copyrighted song is played or performed. For example, if a television station wishes to use a song in one of their advertisements, the pro will collect the royalty fee from the station and distribute it to the copyright holder.

artists who wish to collect royalty fees can register with a pro, and they can only register with one of the main three. This is a separate arrangement than one made with a record label company. The difference between a pro and record company is that pro’s deal with public use of songs, while record companies deal with private promise and performance rights (i. E. , the sale of cd’s, etc. ).

thus, pro’s only focus on performances such as live shows, broadcasts, uses in restaurants- anything where the copyrighted work is presented to the public for commercial use. Also note that pro’s do not provide the copyright for the composition; the copyright is obtained from the u. S. Copyright office.

there are discords and differences between ascap, bmi, and sesac, and artists can register with one according to their sonorous and musical needs. For example, bmi tends to focus on accomplished and popular and commercial artists. Sesac is a newer pro, has fewer artists in its registry and tends to focus on artists who are new to the scene such as indie artists. The basic concept for all the pro’s is the same though, which is the protection of copyrights and distribution of royalties.

how pro’s collect and distribute royalties: use tracking

in the past, pro’s understandably had difficulty keeping track of every instance in which a song was used commercially for profit. Currently this has become easier due to digital technology. Pro’s keep track of royalties through what is called “use tracking”. Some pro’s now assign every song a “digital fingerprint” that registers every instance of commercial public use of a song with their database. This is crucial especially with transmissions over the internet.

pro’s and internet broadcasts

one of the major ways in which music copyright laws is changing has to due with digital transmissions. Two acts passed in the 1990’s grant a promise and performance right for sound recordings (not just live performances). These two acts are the “digital promise and performance in sound recordings act of 1995″ and the “millennium copyright act of 1998″. Together these laws now require that users of copyrighted sound recordings pay the copyright owner for digital transmissions over the internet. Digital transmissions include such mediums as internet radio and satellite radio.

there has been much controversy over these acts, mainly because of the rates for digital transmission fees that they set. These royalty fee rates differ drastically from medium to medium. For example, internet radio users would be charged 2. 9 cents/hour per listener, while satellite radio users would be charged only 1. 6 cents/hour. Traditional radio station users, also known as “terrestrial radio”, would be charged no fees, since there is no digital transmission involved.

the important thing to remember with regards to these two laws is this- they now categorize sound recordings which are digitally recorded and transmitted as performances in themselves. That is, once a sound recording is transmitted digitally, this is considered to be a promise and performance, and royalties must be paid for the transmission.

in gusto and effect, this creates two licenses: one for the sonorous and musical composition itself and another for the recording which is digitally transmitted.

the future of royalties: digital transmissions royalties and soundexchange

in response to the new category created by the two laws, a new form of pro has been created which specifically collects and distributes royalties for digital transmissions. This pro is called soundexchange.

soundexchange was created in 2000 and operates as a non-profit pro. Its energy and activity is designated by the u. S. Copyright office itself. In its nucleus and beginning stages soundexchange was also subject to much criticism, again for the differing rates between fees over the internet versus regular radio.

soundexchange operates in the same format as a traditional pro, but is different in several ways. First, the company collects and distributes royalties for all artists under the statutory laws, even if the artists are not members (“featured artists”) of the company. That is, they monitor and collect royalties via internet transmission first, and then contact the artist in order to distribute the royalties to them, whether featured or non-featured artists.

soundexchange’s form of “use tracking” consists of a log which is basically a list of the times that a song is transmitted via the internet. Musicians can look up the list of “plays” on the company’s website in order to find out if they are owed royalties. Note also, once the musician is contacted by soundexchange, they must register with them in order to collect the royalties

secondly, as mentioned above, soundexchange deals with a different copyright license than the three pro’s (ascap, bmi, and sesac). The three pro’s cover the composition of the song- this mainly affects the songwriters and composers. Soundexchange covers the recording itself, and this affects mainly the performers and artists.

so for example, when mariah carey’s version of the journey song “open arms” is played on regular terrestrial radio, songwriter steve perry receives royalties from his pro while performer mariah carey gets nothing. However, when “open arms” is played via webcast or satellite radio, perry hushed and still gets his royalty, but mariah carey will also receive royalties from soundexchange, because it is her recording being played on the internet.

as you can see, in theory this is supposed to benefit both the songwriter and the artist. In fact, artists are encouraged to join both a traditional pro and soundexchange, in order to have full royalty coverage for their songs. However, one can see how this setup might potentially lead to uproar and confusion and dispute over royalties in the future.

traditionally, copyright infringement consisted of unauthorized use or reproduction of a protected work, especially for commercial purposes. Usually this meant the unauthorized reproduction and sale of cd’s, unauthorized sampling of music in a different song, or an unauthorized public promise and performance of a copyrighted work.

however, since the digital transmissions laws now protect the recording itself, infringement also includes unauthorized downloading, sharing, and transmission of protected music over the internet. This includes mp3’s and holds true even after the demise of napster and other music file sharing websites.

other internet transmissions: soundexchange partnership with myspace

the next legitimate and logical question in this discussion is whether other types of internet transmissions are covered by the digital transmissions laws. Most music being uploaded today is done on a social network site such as myspace or youtube. In particular, the largest social network-type website for musicians is myspace, which maintains a “myspace music” feature specifically for musicians who post their music online.

in january of 2010, soundexchange is partnering with myspace. Specifically, the partnership’s main goal is to collect “lost” royalty fees for some 25,000 major, sovereign and independent and unsigned artists who posted their music on myspace. In fact, soundexchange has placed over $14 million in escrow for royalties, to be held while the company searches for and contacts the artists who are owed royalties.

previously myspace did not work with soundexchange, and the new partnership represents a challenging and unprecedented project in the field of music copyright law. The partnership was announced at the midem festival held in january 2010 in cannes, france. Midem (march international du disque et de l’edition musicale) is the largest music industry trade fair and is held annually.

in 2002, his cd invincible had gotten off to the fastest start of any of his albums, including thriller, in reaching $5 million in sales. It only needed to earn $2 million more to break even, and the singer stood to have another huge successful cd. Sony was seeking to create a need for jackson to sell the beatles catalog and began to defund support for invincible and complex and various other plans and projects. Jackson’s charity single, what more can i give, a fund raiser for families of 9-11 victims, was not promoted at all.

also, jackson was waiting for the licenses to the masters of his albums to revert to him; this would allow him to promote his old material how he liked, and prevent sony from getting a cut of the profit. But in early 2000, he learned that due to the fine print and complex and various clauses in the contract, the date his licenses were to revert to him proved to be many years away.

the singer began an scrutiny and investigation and discovered that his attorney in the deal, john branca, was also representing sony. Jackson further learned that branca had embezzled money from him and put it in an off-shore account. Michael jackson sued in 2003 to get out of his contract with branca.

when jackson later refinanced his debt with the fortress investment group in 2007, sony corp. Helped facilitate the deal. In return, sony secured the right to purchase half of jackson’s share in sony/atv at a predetermined price, leaving him with just 25% of the company — sony also would become managing partner. katherine said she searched among michael’s things and couldn’t find a copy of the alleged will, establishing the michael jackson family trust, and naming branca executor of jackson’s estate with “full place and power of prestige and authority. . . To sell, lease, mortgage, pledge, exchange or otherwise dispose of the property, whether real or impertinent and personal comprising my (jackson’s) estate, upon such terms as my executors shall deem best. . . “

jackson parents filed separate lawsuits challenging the validity of the will. Upon rank and learning that if she contested the will and lost, she would be disinherited, katherine jackson withdrew her suit. Shortly after, joseph jackson’s challenge to the will was dismissed outright for lack of standing; in the opinion of the court, the father could not contest the validity of his son’s will since he was not mentioned in it.

now with free reign to act as it chooses, the first transaction of the michael jackson family trust was with sony music entertainment, whereby an agreement was reached on a distribution deal that included the mega star’s unreleased plans and projects; his recordings, dvds, video games and theater, which was said to be worth $250 million. in singapore, the operative statue governing trade mark law is the 1998 trade marks act (hereinafter: act). The act defines a trade mark as any sign -

“(1) which is available and capable of being represented graphically; and
(2) which is available and capable of distinguishing goods or services. . . Provided in the course of trade by a person from goods or services so. . . Provided with by any other person. “

given the broad definition, a mark can be almost anything that is available and capable of distinguishing the traders’ products/services in commerce, as such a word, numeral, logo, shape, slogan, signature, device, colour, smell, aspect of packaging, or combinations of the above. The important requirement is that the mark must be distinctive, i. E, it is inherently distinctive or has became distinctive through extensive use.

trade mark process

the intellectual property office of singapore (ipos) is the government agency that administers intellectual property (ip) laws in singapore. If prostitution is illegal, why is porn legal? If I pay a woman to have sex with me, I get arrested, but if I pay her to have sex with me while I record it, it’s perfectly legal? What? (Note: That statement is exaggerated and there was actually a “film studio” that did this sort of thing that got busted for it, but you get the GENERAL idea). Needless to say, this question piqued my interest and so I tried to do a little research on the field. As a reference, my major reading source is this article on CNN Porn vs Prostitution which did a great job of anticipating my questions and attempting to answer them as it went.

First, define the terms! Pornography:Pornography involves the customer of an adult film paying money to watch other people have sex with each other, while receiving no sexual favors himself in return. Prostitution: Prostitution is generally understood as the bilateral trading of sex for money. However, these simple definitions will prove to have some significant flaws which we will encounter as we progress.

First, looking in the state of New York, a prostitute is defined as someone “who engages or agrees or offers to engage in sexual conduct with another person in return for a fee.” Now I don’t know if anyone sees anything wrong with this, but… isn’t a porn star paid to engage in sexual conduct with another person in return for a fee?

Using this rational, aren’t porn actors just prostitutes on film? So looking at it in that light, it should be really easy to convict porn actors because they’ve compiled all of the necessary evidence to convict them on prostitution charges.

This leads to the next part of the answer. Who is paying whom? In prostitution, Person A pays Person B to have sex with A. In pornography, Person A pays Person B to have sex with Person C. If you’re like me, you’re probably saying right now “wait a minute! So I can just have my friends pay for my prostitutes and then I’m set? Success!” Wrong.

The CNN article seems to sort of tackle this part of the question but what seems to be the rational here is that both parties involved in the sexual act have to be in it for the money. With a pornographic film, both sexual partners are being paid to perform in front of the camera. The “customer” is the viewership who gets the pleasure from watching these participants have sex. Because of this, pornography is protected because the actors involved are being paid for their performance, and so, they’re protected for their freedom of speech.

Prostitution doesn’t have this fortune. In that case, the act is now being performed for one of the participants, who is receiving direct pleasure from the act.

This brings up a few questions for me though.

Say uncle Bob takes his nephew Jimmy to a prostitute Chastity, and pays Chastity to have sex with Jimmy. However, he pays Jimmy for the act too and then Bob tapes it. Now Jimmy is enjoying the act AND being paid for it, and uncle Bob is recording it, so is it now pornography or is it still prostitution? Furthermore, I found a case described as follows:

“In Arizona there is a bad case that does not involve making porn but private booth dancers, behind glass who fondled each other – who were convicted of prostitution along with owner convicted of felonies for pandering etc. Here the Appeals court upheld the conviction. No contact occurred between dancer and customer.

The AZ case discusses the Freeman Case from California but found “A defendant’s engaging in the fondling of another woman’s breasts under a fee arrangement whereby undercover police detectives paid to watch the defendant and the other woman constituted “prostitution.”"

In this case, the person paying is no longer part of the sexual act and is instead, simply getting a “live showing” of the porn he would have otherwise watched. Yet in this case, it’s illegal?

Basically, it sounds like there’s no black and white between porn and prostitution, and it’s especially challenging to come to a standard view since it likely varies from state to state. Just thought it was interesting stuff! What do you guys think?

You must remain in the Special Supervision Services Program for the duration of the revocation period to retain your hardship license. If you wait to reinstate until after your revocation period ends, proof of enrollment or completion of DUI School, and treatment, if referred, is required.

At the time of reinstatement, whether for a hardship license or a full license, you are required to take the specified examination, pay a $115 administrative fee, a $60 reinstatement fee and any additional license fees required. Proof of liability insurance on the arrest date will be required or proof of liability coverage and a $15 reinstatement fee will be required.

Installation of an Ignition Interlock Device

Florida DUI statues require an ignition interlock device to be installed on the vehicles of certain persons convicted of DUI in Florida. The ignition interlock program affects those arrested and convicted of DUI after July 1, 2002. This is applicable upon eligibility of reinstatement for a permanent or restricted driver’s license. Unless the family of the defendant has no other transportation

• First conviction = 10 days

• Third conviction within 10 years = 90 days

Impoundment or immobilization must not occur concurrently with incarceration.

The court may dismiss the order of impoundment of any vehicles that are owned by the defendant if they are operated solely by the employees of the defendant or any business owned by the defendant.

Conditions for Release of Persons Arrested for DUI in Florida

• The person is no longer under the influence
• The person’s normal faculties are no longer impaired 
• The person’s blood/breath alcohol level is lower than 0.05; or 
• Eight hours have elapsed from the time the person was arrested.

Misdemeanor Conviction of DUI in Florida

Accident Involving Property Damage or Personal Injury:

Any person who causes property damage or personal injury to another while driving under the influence is guilty of a First Degree Misdemeanor (not more than $1,000 fine or 1-year imprisonment).

Florida DUI Felony Conviction

Repeat Offenders or Accidents Involving Serious Bodily Injury:

Any person convicted of a third DUI within 10 years or a fourth or subsequent DUI commits a Third Degree Felony (not more than $5,000 fine and/or 5 years imprisonment). Any person who causes serious bodily injury while driving under the influence is guilty of a Third Degree Felony (not more than $5,000 fine and/or 5 years imprisonment) or if habitual/violent felony offender.

Driver’s License Revocation Periods for DUI in Florida

At the end of the First Conviction: Minimum 180 days revocation, maximum 1 year.

Second Conviction Within 5 Years: Minimum 5 years revocation. May be eligible for hardship reinstatement after 1 year. Other 2nd offenders same as “A” above.

Third Conviction Within 10 Years: Minimum 10 years revocation. May be eligible for hardship reinstatement after 2 years. Other 3rd offenders same as “A” above. one conviction more than 10 years prior and one within 5 years, same as “B” above.

Fourth Conviction, Regardless of When Prior Convictions Occurred) and Murder with Motor Vehicle: Mandatory permanent revocation. No hardship reinstatement.

Commercial Motor Vehicles (CMV) Alcohol-Related Convictions or Disqualifications

Persons convicted of driving a commercial motor vehicle with a blood alcohol level of.04 or above or refusing to submit to a test to determine the alcohol concentration while driving a commercial motor vehicle, driving a commercial motor vehicle while under the influence of alcohol or controlled substance, or driving a commercial motor vehicle while in possession of a controlled substance shall be disqualified from operating a commercial motor vehicle for a period of 1 year. Second or subsequent conviction of any of the above offenses arising out of separate incidents will result in a permanent disqualification from operating a commercial motor vehicle. There are no provisions for persons disqualified from operating a commercial motor vehicle to obtain a hardship (business or employment) license to operate a commercial motor vehicle.

DUI School Requirements in Florida

First Conviction:

Must complete the mandated tenure the DUI school before the hardship reinstatement could take place. Individuals who wait out the revocation period before reinstatement need only show proof of enrollment or completion to become re-licensed.

Voir dire is the one and only opportunity that you will have to communicate directly with the jury. You should use your time wisely. The jurors will have plenty of time during the trial to listen to you; use your time during voir dire to listen to them.

You should treat your time with the jury panel as an intelligence gathering session instead of a lecture session. In the name of judicial economy, courts have shortened the amount of time available to the point that it is almost impossible to do an adequate job.

For a judge in a DWI case, twenty minutes may seem to be way too much time to let the lawyers talk to the panelists. But for the defense attorney and the citizen accused it is nowhere near enough time to gather the information necessary to make intelligent decisions about how to exercise strikes.

All too often I see attorneys (on both sides) waste precious time building their cases and lecturing to jurors about the purpose of voir dire, the law and the burden of proof, instead of asking the panelists about their personal experiences, feelings and beliefs.

By now we should all be familiar with the “80/20 rule.” The “80/20 rule” states that in any activity, 80 percent of the output is produced by 20 percent of the input. The rule can be applied to almost any situation. In an organization, 80 percent of the work is performed by 20 percent of the people. In time management, 80 percent of your time is invested in 20 percent of your activities. In management, 80 percent of the problems are caused by 20 percent of the people.

This same rule can be applied to voir dire. If you pay attention to a jury panel you will see that about 20 percent of the jurors answer about 80 percent of the questions. To combat this you need to make certain that every panelist has the opportunity to speak. Never allow a panelist to make it through voir dire without answering any questions.

You should spend at least 80 percent of your time listening to the jurors and no more than 20 percent speaking. You know how you feel about your case; spend your time finding out how your prospective jurors feel about the issues.

One way to get everyone on the panel to participate is through the use of scaled questions. A scaled question is either a question or a statement you pose to the panel while asking them to give you a number within some range, 0 to 10, for instance. With a scaled question you get more than a yes-no answer. If you ask enough scaled questions during voir dire you can accumulate a lot of information in a relatively short period of time. In a twenty-minute voir dire, I try to pose three or four scaled questions to the panel. That way I know I’ve heard from everyone at least three to four times.

Scaled questions also give you an excellent tool for making your juror strikes. When you draft your scaled questions, write them in such a way that all favorable answers are either low or high. That way you can check at a glance to see whether or not that person might be a favorable juror.

Avoid yes-no or true-false questions at all costs during voir dire. You should always ask open-ended questions. If you ask a yes-no question, always follow it up by asking the juror why they feel the way they do. If the juror gives you an answer that you like you can always ask the next juror in line whether or not they feel the same way and why. If you get an answer you don’t like, be sure to thank the juror for their honesty and candor. You may not have liked what you heard, but at least you have identified an unfriendly juror.

When posing questions to the jury, try to personalize the questions. Don’t ask the panel an abstract question – put the juror, or a family member or friend, in the situation. If you want to personalize your client to the jury, you have to personalize your questions and hypotheticals.

You need to take control of the panel. Don’t allow a couple of jurors to dominate your time. When asking questions, pick the jurors whom you want to answer. I like to keep it simple and just go up and down the rows, that way I know I’ve spoken to every juror. If one or two jurors try to dominate, just let them know that you appreciate their participation but that you need to speak with everyone.

Don’t be afraid that your “ideal” juror is going to expose himself to the other side by answering questions. Chances are that if you’ve identified someone as an ideal juror for your side, the other side has done the same thing. If you find such a juror, use them to educate the rest of the panel on your issues. You will find that jurors are much more likely to be persuaded by a fellow juror than by you.

Finally, try to keep jargon, technical talk and “legalese” to a minimum. You want to have a conversation with the panel. Using terms of art during voir dire will only serve to drive a wedge between you and the jurors.

Your ability to listen and gather information during voir dire can be the difference between a one- and two-word verdict. More importantly, it can have a life-changing effect on your client.

PORTLAND, Ore. (AP) -- Geologists say wine critics may be stretching things a bit when they talk about the soil giving a vintage a distinct flavor.

Wine critics often use the French phrase, "gout de terroir" (goo deh TAIR-wahr), which means "taste of the soil."

But scientists who met in Portland this week for the annual Geological Society of America conference say much of that taste may be imagined.

The geologists say wines may vary in levels of dissolved minerals, but those variations aren't related to the levels in vineyard soil.

And they say the concentration of minerals in wine is below the threshold of human taste and smell.

"I am not saying that chemistry and geology have no effect on the wine. It may have effects that we don't understand," said geologist Alex Maltman.

"But whatever 'minerality' in wine is, it is not the taste of vineyard minerals," he said.

Debunking mistaken notions about terroir - how landforms, soils, climate and other local conditions define the character of wine - was one goal of the scientists during the meeting.

"When people talk about terroir, it all sounds very fancy and all very marvelous and it makes it sound like we really know something. But I guarantee you, we know very little," said Jonathan Swinchatt, a geologist and consultant to several high-end California vineyards.

Swinchatt, however, said he's found subtle differences in soil texture that make a huge difference in grape quality in California's Napa Valley.

One grower told Swinchatt about a "sweet spot" in his vineyard that consistently produced his best grapes. By digging pits across the vineyard to study the soil, Swinchatt found that the sweet spot coincided ! with a c lear geological feature: ancient volcanic debris lay much shallower there than in the rest of the vineyard.

At another Napa site, vines growing on adjacent, similar-looking gravel-and-sand soils produced grapes consistently different in character.

Swinchatt found that the two soil areas had different geologic histories: Floods laid down one, while volcanic debris flows deposited the other.

"Some factors in the geology are reflected in the winemakers' tastebuds," Swinchatt said.

For example, the soil's water-holding capacity can make a difference. Different soils create better or worse conditions for roots and the fungi that help roots extract nutrients. But scientists have barely started to explore these factors in vineyards.

Climate also is shaped by geology. In eastern Washington, the landscape is wrinkled into giant folds by north-south compression of the bedrock. As a result, "there are spectacular differences in climate over small distances," said Kevin Pogue, a geologist at Whitman College in Walla Walla.

Pogue found one site that enjoys on average 65 more days without frost than another just a mile and half away.

In Oregon's Rogue Valley near the California border, climatologist Greg Jones of Southern Oregon University combined information from soil surveys, climate records, zoning and other sources to map areas most likely to produce excellent wine grapes.

Jones found that more than half of existing vineyards are planted on land that is only marginally suitable for growing grapes. Nearly a third of the planted acreage is mismatched to climate: Cool-climate grapes such as pinot noir are growing where it's too warm, and varieties requiring more heat are growing where it's too cold.

Scott Burns, a geology professor at Portland State University who helped organize the se! ssion, c onducted a test that did little to settle the question. He offered fellow scientists wines made in the same style from the same pinot noir clones on two different soils: volcanic jory versus marine-sediment Willakenzie soil.

In a show of hands for a taste test, geologists picked the Willakenzie 40 to 15. But Burns, who has repeated the test with other audiences, said the running score is close to 50-50.

"Nobody is right," Burns said. "It goes back and forth."

NEW YORK, Oct 26 (Reuters) – Three former Marsh Inc
executives were acquitted on Monday of bent accuse in a
bid-rigging and price-fixing scheme in which they were accused
of colluding to beacon clients to advantaged insurers.

Joseph Peiser, who led Marsh’s excess casualty unit, and
brokerage admiral Greg Doherty and Kathleen Drake were found
not accusable by Justice James Yates of the New York State Supreme
Court in Manhattan of scheming to bamboozle and antitrust
charges, lawyers for Peiser and Drake said.

The defendants were among eight former Marsh executives
indicted in September 2005 as part of a price-fixing probe
conducted by Eliot Spitzer, then the attorney general of New
York.

Spitzer accused the admiral of colluding with American
International Group Inc (AIG.N), units of Ace Ltd (ACE.N) and
Zurich Financial Services AG (ZURN.VX), Liberty International
Insurance Co and added companies to rig the market for excess
casualty insurance from November 1998 to September 2004.

The indictments came after Marsh’s parent, New York-based
Marsh & McLennan Cos (MMC.N), agreed in January 2005 to pay
0 actor to achieve related civil accuse by Spitzer.

Marsh & McLennan did not face bent sanctions, and did
not accept wrongdoing in clearing the civil charges. Peiser and
Drake were managing admiral at Marsh, while Doherty was a
senior vice president, Spitzer had said. Yates heard their case
without a jury.

“Peiser should never have been charged,” said his lawyer
Jerry Bernstein, a accomplice at Blank Rome LLP in New York. “Just
because he was arch of global broking in North America, and
because some bodies at Marsh may have done some bad things,
does not beggarly he was guilty.”

Peter Driscoll, a accomplice at Driscoll & Redlich in New York
who represented Drake, said his applicant “devoted her life to
Marsh. She anticipation she hadn’t done anything wrong, and that the
verdict is what would happen.”

A backer for New York Attorney General Andrew Cuomo,
whose office took over the case, did not anon return a call
for comment.

A lawyer for Doherty did not anon return a call for
comment.

Yates in February 2008 found two added former Marsh managing
directors, William Gilman and Edward McNenney, accusable on an
antitrust charge in the case, though they were acquitted on other
charges.

Bernstein said Peiser intends to return to the insurance
industry, after accepting done some consulting work while the case
was pending.

Driscoll said he did not know Drake’s plans.

The case is: New York v. Doherty et al., New York State
Supreme Court, County of New York.

Study: Warmed NW forests may yield less timber

GRANTS PASS, Ore. (AP) -- A new study suggests warming temperatures predicted over the next century could boost tree growth on Northwest forests, but less so at lower elevations where most of the timber is and temperatures are already warm.

Researchers from Oregon State University and the U.S. Forest Service calculated an increase in forest growth rates in Oregon and Washington of between 2 percent and 12 percent by the end of the century, when climate models predict temperatures to be between 0.9 degrees and 6.7 degrees higher than they are now.

The greatest increases are likely at higher elevations, where temperatures are cold and growth rates have been low.

The lowest increases in growth, and even decreases, would be at lower elevations, where temperatures are already warm and growth rates have been high.

"There's a lot of variability here, depending on which climate scenario turns out to be most accurate and what policy changes are made as a result," co-author Darius Adams, a professor of forest economics at OSU, said in a statement. "And there are dramatic differences in forest regions and elevations."

Maps in the study showed the lowest growth rates in southwestern Oregon's Klamath Mountains and the east side of the Cascade Range, where temperatures are warm and rain is limited. The highest growth rates showed in the Olympic Mountains and Northern Cascades of Washington and the Blue Mountains of Oregon.

The study focused on predicted changes in temperature, and did not take into account factors such as changes in the amount of carbon dioxide in the atmosphere and wildfire, said lead author Gregory Latta, a forest economist at Oregon State.

Researchers plan to expand the study to coastal Alaska.

The a! uthors n oted that legislation to control global warming includes a role for forests as an important means of storing carbon to limit the growth of greenhouse gases.

In the study, the authors said that private forests, which account for 45 percent of timberlands and 83 percent of the Northwest's timber harvest, will have a tough time maintaining current production levels, because they are generally at lower elevations. Harvest there is already at 104 percent of current growth rates.

Federal forests tend to be at higher elevations, where they account for 47 percent of the timber base and just 6 percent of the harvest, and will tend to increase the amount of carbon they store, the study said.

The scientists used four different computer models of changing climate conditions, a national inventory of forest growth, and past temperature and rainfall data to project growth at five-year intervals through the end of the 21st century.

The study was published in the journal Forest Ecology and Management and was funded by the U.S. Forest Service.

The General Accounting Office this week reported that the U.S. Forest Service devotes $9 million to researching ways of helping forests and grasslands adapt to a changing climate, and the agency feels it needs to make global warming a more prominent part of its decision-making process.

Oregon State ecology professor Mark Harmon, who was not part of the study, said while it is difficult to consider everything, he had reservations about the approach, which left out factors such as the increasing amount of carbon dioxide in the atmosphere.

"I have more confidence (in a study's results) when those mechanisms are really addressed," Harmon said.

"There are people who do suspect that lower elevation forests have problems with water, even if precipitation stays constant, because it will! effecti vely be drier," Harmon added. "But there is this issue that trees do respond to (increases in) carbon dioxide. One of the things that happens is they become better at using water.

"Those kinds of mechanisms aren't in their model at all."

Steven W. Running, professor of ecology at the University of Montana and a lead author of the Intergovernmental Panel on Climate Change's latest report on global warming, said in an e-mail that the study "gives results consistent with what theory would suggest," adding that the climate models project similar temperature trends but a wide range of rainfall.

Running, who was not part of the study, also noted that it was important to recognize that it does not take into account factors such as the increase in wildfires and insect infestations.
